TERMS & CONDITIONS

Conduct of Guests:

1. All charters must be conducted in accordance with the laws of Singapore and the regulations of MPA and any other relevant government authority. Guests must observe and adhere to all such relevant laws and regulations, including any Covid-19 regulations, failing which the Captain has the right to terminate the charter without compensation, head back to the marina, and if necessary report the offending action to the relevant authority.

2. All charters must be conducted in a safe manner. Guests must follow all relevant safety regulations and the advice of the Captain in matters of safety. Should guests behave in an unsafe manner such that there is, in the judgement of the Captain, a risk of injury to or loss of human life, they will be advised to stop such unsafe behaviour. If such advice repeatedly goes unheeded, the Captain reserves the right to terminate the charter without compensation and head back to the marina.

Bookings and Payments:

1. All payments are non-refundable.

2. Bookings are confirmed only after payment has been received. No contract with or obligation from the company exists without payment being received.

3. All bookings made are for a specific date, time, and group size, which are fixed at the point of booking and are not generally transferable to another date or time. No refunds for having less pax than paid for.

4. Any exceptions made for changing date or time, or changing boat, after payment is made and charter booking confirmed, is solely at the discretion of the company and the boat owner, and will carry hefty financial penalities which will depend on the boat, date, time and number of pax requested.

5. Customers are therefore advised to only make a booking when they are sure of the date and time, and when they are sure that their eventual group size will not exceed the maximum capacity of the boat chosen.

Inclement Weather:

If the weather is inclement such that the captain judges it unsafe to go out to sea, the company may offer guests a reschedule of their charter without charge, subject to availability, provided the following conditions are met:

1. The decision whether or not to postpone is to be made by the captain, who is a licensed professional and experienced seaman, based on weather conditions at the time of charter and at the point of departure, and not before, or at any other location;

2. No reliance on weather forecast, only actual weather conditions observed at the time and place of charter;

3. All guests must be present at the point of departure, i.e. at the marina, at the time of the charter;

4. Payments made for food are non-refundable and non-transferable. In the event of any reschedule, any ordered food will be released to the customer.

5. If the weather turns inclement during the charter, after the boat has left the marina, the Captain shall exercise his discretion and may head back to port if the weather conditions are inclement enough to pose a risk to the safety of the guests. In such an instance, no refund or reschedule will be offered for the unexpired portion of the charter.

6. Customers are therefore advised that bookings made are not conditional upon what they consider as "good weather", and will only be postponed if the captain thinks there is weather inclement enough such that it is unsafe to go out to sea.

Risks and Liability:

While the captain is a licensed and experienced professional, and all charter boats are sea worthy, going to sea nonetheless inherently carries a small amount of risk which cannot be completely eliminated. All charters are undertaken at the guest's own risk. The company, captain, and crew are not responsible for any injury to or loss of life, or for any damage to belongings. Acceptance of this invoice and payment made denotes acceptance of the risks involved and waiver of any liability on the part of the company or its staff.
