Terms and Conditions for iDrive.SG

1. Introduction Welcome to iDrive.SG, operated by Digitalguru Pte Ltd (UEN: 202346833W). By accessing or using our platform, you agree to comply with and be bound by the following Terms and Conditions. These terms govern your use of our website, services, and all related interactions.
2. Definitions
- “iDrive.SG” refers to the vehicle rental platform operated by Digitalguru Pte Ltd.
- “User” or “You” refers to any individual or entity using iDrive.SG, including renters and rental companies.
- “Rental Company” refers to any business or individual listing vehicles for rent on iDrive.SG.
- “Renter” refers to any user who books a vehicle through iDrive.SG.
3. Use of the Platform
- Eligibility:
- To use iDrive.SG, you must be at least 18 years old and legally capable of entering into contracts.
- Account Registration:
- Users must create an account to access certain features of iDrive.SG. You are responsible for maintaining the confidentiality of your account information and all activities under your account.
- Prohibited Activities:
- Users may not use the platform for any unlawful activities, fraudulent purposes, or to interfere with the operation of iDrive.SG.
4. Vehicle Listings
- Accuracy:
- Rental companies are responsible for ensuring that their vehicle listings are accurate, up-to-date, and complete. iDrive.SG is not liable for any inaccuracies in the listings.
- Compliance:
- All vehicles listed on iDrive.SG must comply with local regulations and be insured as required by law.
5. Booking and Payment
- Booking Process:
- Renters can book vehicles through the platform by selecting available options and providing necessary information. Once the booking is confirmed, a contract is formed between the renter and the rental company.
- Payment Terms:
- Payment is required at the time of booking. iDrive.SG processes payments on behalf of rental companies. Payment methods include credit cards, digital wallets, and other options as provided on the platform.
- Fees:
- iDrive.SG may charge service fees to renters for the use of the platform, which will be disclosed during the booking process.
- iDrive.SG may charge platform fees to rental companies for listing vehicles for rent on the platform which will be charged upon any successful rental.
6. Cancellation and Refunds
- Cancellation Policy:
- The cancellation policy applicable to a booking is determined by the rental company and disclosed during the booking process. Renters are encouraged to review these policies carefully.
- Refunds:
- Refunds, if applicable, will be processed according to the cancellation policy selected by the rental company. iDrive.SG is not responsible for disputes related to cancellations or refunds.
7. User Responsibilities
- Renter’s Responsibilities:
- Renters must return vehicles in the same condition as when rented, adhere to all rental agreements, and comply with local traffic laws. Any damage or violations incurred during the rental period are the renter’s responsibility.
- Rental Company’s Responsibilities:
- Rental companies must provide vehicles in safe and roadworthy condition, as described in the listing. They are also responsible for maintaining insurance coverage for their vehicles.
8. Subscription Fees and Cancellation
- Non-Refundable Fees:
o All monthly subscription fees paid to iDrive.SG are strictly non-refundable. No refunds or prorated adjustments will be made for partial months or unused services.
- Subscription Cancellation:
o Rental companies subscribed to iDrive.SG’s monthly plan must provide a 30-day written notice before cancellation. The subscription will remain active, and charges will continue until the end of the notice period.
9. Liability
- Limitation of Liability:
- iDrive.SG is a platform that facilitates vehicle rentals between rental companies and renters. We are not responsible for the actions of rental companies or renters. To the fullest extent permitted by law, iDrive.SG and Digitalguru Pte Ltd disclaim all liability for any direct, indirect, incidental, or consequential damages arising from the use of the platform.
- Indemnification:
- Users agree to indemnify and hold harmless iDrive.SG, Digitalguru Pte Ltd, and their affiliates, officers, and employees from any claims, losses, damages, or expenses arising out of or related to their use of the platform.
10. Privacy
- Privacy Policy:
- Our collection and use of personal data are governed by the iDrive.SG Privacy Policy, which is incorporated into these Terms and Conditions by reference.
11. Personal Data Protection Act (PDPA) Compliance
- By using iDrive.SG, you consent to the collection, use, and processing of your personal data by Digitalguru Pte Ltd in compliance with Singapore’s PDPA.
- Personal data collected includes, but is not limited to, your name, contact information, identification numbers, and other details necessary for account registration, vehicle bookings, and platform use.
- This data may be shared with relevant rental companies to facilitate the rental process and ensure compliance with the platform’s policies.
- Digitalguru Pte Ltd will take all reasonable steps to protect your data and will not disclose it to unauthorized parties.
12. Promotional Use of Published Photos or listing details
- By listing vehicles or booking rentals on iDrive.SG, you grant Digitalguru Pte Ltd the right to use any photos or listing details published on the platform for promotional and marketing activities.
- This includes, but is not limited to, social media posts, advertisements, newsletters, and other materials showcasing iDrive.SG’s offerings.
13. Termination
- Termination by User:
- You may terminate your account at any time by contacting iDrive.SG customer support.
- Termination by iDrive.SG:
- iDrive.SG reserves the right to suspend or terminate your account at any time, with or without notice, for violating these Terms and Conditions or engaging in any activity deemed harmful to the platform or other users.
14. Dispute Resolution
- Governing Law:
- These Terms and Conditions are governed by the laws of Singapore.
- Dispute Resolution:
- Any disputes arising from or related to the use of iDrive.SG will be resolved through binding arbitration in Singapore, in accordance with the rules of the Singapore International Arbitration Centre (SIAC).
15. Changes to Terms
- Modifications:
- iDrive.SG reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on the platform. Continued use of the platform constitutes acceptance of the revised terms.
