Rental Agreement Contract

(“The Company”) OZ Car Rental Pte Ltd, Hirer / Authorized Driver (‘Driver’) Hirer / Driver must produce a valid Singapore Class 3 Driving License and NRIC or valid international Driving License (subject to the company approval) and Passport and guarantees that he/she is not under any suspension order on the driving License status.

Rates

All rates quoted are in Singapore Currency (SGD). Rates will be charged per day except for weekend or public holiday packages. Each excess hour is charged at one-fifth of daily rate. Vehicle returned after office hours WHICH IS 6PM, the hirer will be charged for an additional day. Petrol is not included and is chargeable to the hirer should the vehicle be returned with lesser petrol than when it was collected by the hirer. Petrol will be charge at $30 per gauge marking.

Parking and Traffic Fines/ Fees, ERP charges

Hirer/ Driver is fully responsible for all traffic and parking violations including Cash Card for ERP gantries during the rental period.

Damage to vehicle

Hirer is fully responsible for repair cost, towing fee, loss of use if the breakdown/damage is due to hirer's/ driver's negligence while the concerned vehicle is under repair.

Example: When the rental car indicates an overheat signal, do stop the car at a safety point. Do not continue to drive the car or top up the coolant. Any continuous driving while the car is in overheat situation, hirer is to bear the damage cost to repair or overhaul the engine or any faulty issues.

Restriction on use

Vehicle is restricted to usage in Singapore only. Hirer shall not take the said rented vehicle out of mainland Singapore without the written consent of the Company. Failure to comply with this term may entail serious consequences and the hirer shall assume personal and full responsibility for it. In the event of the said vehicle being damaged in a state of total loss, confiscated, forfeited or seized as a result thereof, the hirer must compensate the Company for all the losses incurred.

The hirer/ Authorized Driver covenants to use the vehicle only for lawful and legitimate purposes. The hirer/ Authorized Driver must not to use the vehicle for any activities of unlawful purposes. It is with this express understanding before the Company leases the vehicle to the hirer.

The vehicle may only be driven by the Hirer or by person or persons who have been expressly designated and authorized herein (hereinafter called the “Authorized Driver”) The Hirer and the Authorized Driver must be in possession of a valid driving license and shall all times drive the vehicle in a careful and skillful manner, observing the traffic regulations and laws.

The Hirer/ Authorized Driver shall refrain from smoking, eating or carrying pets in the vehicle. A cleaning charge of S$300.00 will be levied for smoke odour or dirty vehicle.

Change of rental motor car

The company reserve the right to change the rental car for reason the vehicle described in the schedule of any other vehicle reserved by the hirer prior to the commencement of the period of rental is available at the time of such commencement, the Company shall have the right to replace the said vehicle with an alternative vehicle of similar seating capacity and performance. If no such alternative vehicle is available, the company shall decline to provide an alternative vehicle. The Hirer shall be refunded by the rental charge and deposit paid by him after offsetting any Hiring charge and costs incurred by the Company. The Hirer then shall have no other claim of any kind whatsoever against the Company.    

Excess

Accident that results or have any Third-Party claim involving the Company's Car Insurance, the hirer is responsible to pay the Company both 3rd party insurance excess and own damage excess. The information of the excess shall be divided into three sections. In event the damage does not involving any third-party claim, the damage fee and loss of use will be quoted by the company as of the market value.

Section 1: Driver's age above 24 AND above 2-year driving experience, excess of SGD$6000.

Section 2: Driver's age under 24 /or under 2-year driving experience, excess of SGD$10000.

Section 3: Any accident that occurred outside of Singapore, excess of SGD$12000.

*** Own damage excess does not cover total loss of motor car.

*** Insurance excess does not cover the loss of use during the repair downtime.

Example of a case. Hirer (A) with motor car A had an accident with motor car (B). Motor car (B) file an insurance claim (property or personal injures) against motor car A. Under this, motor car (A) hirer is liable for both third party excess and own damage excess. If the excess for own damage excess is not adequate to repair or rebuild the damage car of oz car rental to the original state, hirer of the rented car has to top up the different apart from the own damage excess, Loss of use and administrative fee will be incurred. Third party excess will remain as stated in the contract.

In event of an accident with total loss or beyond economical repair, hirer will have to bear the cost of the rented car as of the market value and any finance charges incurred by the company.

Hirer agrees that the company reserves the right to increase the Excess Amount at its sole and absolute discretion for the Vehicle and any other Vehicle(s) leased by the company to the hirer under any agreement.

Rental Extension

If the Hirer wishes to extend the hire period, he/ she must inform the Company immediately and will be required to make payment for the extension, provided the hire extension is accepted by the Company.

Terms of Payment

All outstanding hire charges arising from the hire period must be cleared by the hirer at the point of returning the vehicle. No part of any rental charges shall in any circumstances be refundable except at the discretion of the company. Hirer is to pay a refundable deposit quoted by the company that will be due back to the hirer 10 days from the end of the hiring Period.

Termination

Hirer will be liable for a penalty of SGD$3000 for withdrawing or early termination of contract during the mentioned rental period.

Refund policy

In event of any break down of rented car the company will arrange a replacement car if any. If no replacement car is available there will be a refund to hirer for the loss of use on the rental. There is strictly no refund on rental or compensation if the aircon or sound system is faulty.

Penalties on sublet and unauthorized repair

The Hirer is NOT ALLOWED to sublet or lend the rented vehicle to a third party without the authorization from the Company, during or within the rental period. If the vehicle is found to be driven by anyone other than the hirer or the Authorized Driver named in the rental Agreement, the vehicle will be seized by the Company without any refund. If the hirer lends the vehicle to a third party without notification to the Company, and the vehicle is involved in an accident, the hirer will bear the whole cost of the claim and repair costs of the vehicle rented and other damage claims. If the vehicle is involved in an accident, the hirer has to inform the company immediately. No repair is to be done without the Company approval. If the Hirer is caught repairing the vehicle at any workshop unauthorized by the company, compensation of S$8000.00 is payable to the Company. The vehicle must be refueled with unleaded 95/98 or V POWER only. The Hirer is REQUIRED to return the vehicle and key/ key tag with the same condition when he/she rented from the Company. Losing or damaging of the key tag will be charged at $50.00. Any damages of the concerned vehicle will be charged to the hirer according to the renewable repair costs, in order to restore the said damage to the same condition as per it was at the start of the rental. If the hirer driving the rental vehicle was found that the vehicle was used for racing, exiting Singapore without written consent/ undeclared location, sublet/ or lend without authorize by the Company, each clause will be payable as an “compensation” of S$5000.00 to the Company.

Overdue rental payment

The rented motor will have a late fee of $30 per day for any late Calander day. The rented motor car will be repossessed by the company if the rental fee is not paid on time. Any belonging in the repossessed motor car will be discarded by the company if hirer does not claim it back within 48 hours. A repossess fee of $500 will be imposed and other charges if any, example damages, outstanding rental.

Suspended or Revoked Driver License

Hirer have to update the company immediately if the driver license is suspended or revoked. The rental car has to be tow back to oz car rental office at their own cost.
