TERMS AND CONDITIONS

MCL Garage, the company, hereby agrees to let the Hirer take on the hire of the said motor vehicle subject to the following terms and conditions:

Rates quoted are in Singapore Dollars, covering a full 24-hour agreed mileage rental, maintenance, insurance and a 24-hour breakdown service.

The Hirer must be over 19 and below 65 years of age, possess a valid Singapore Class 3 or International driving license Permit, held for at least two years.  

A deposit equivalent to one month's rental and rental fee for the period of hire is payable before commencement of the rental, unless otherwise.

The hiring shall commence on the date the time specified in the rental agreement and shall continue for the period and end on the date and at the time therein stated unless extended as expressly requested by the Hirer.

If for any reason the vehicle ordered by the Hirer is not available. The Company shall have the right to replace the said Vehicle with an alternative vehicle of similar seating capacity and performance. If no such alternative vehicle is available or if the Company shall decline to provide an alternative Vehicle then the Hirer shall be repaid any hire charge and deposit (if any) after offsetting the rental charge and costs incurred, but shall have no other claim of any kind whatsoever against the Company.  If no deposit is paid, the Hirer must pay for rental charges incurred on demand.

The Vehicle may only be driven by the Hirer or by persons who have been registered in the rental agreement. It is expressly forbidden to rent the vehicle out to third persons or permit the vehicle to be used for the purposes that conflict with the law, the Hirer shall indemnify the Company for the value of the Vehicle and bear all costs incurred should the vehicle be seized, confiscated or forfeited, The Hirer shall be liable for late payment at a daily interest rate of 1.5% per month of any sum Owed to the Company in accordance with the provision of this Agreement such interest shall accrue for the agreed date of the return of the said vehicle by the Hirer to the Company, regardless of whether the Hirer in fact returns the said Vehicle.

In case of an accident with the Vehicle during the Hirers use, the Hirer undertakes to do the following:-

• obtain the names, identity card number, addresses of all parties involve and / or witnesses, pictures of the damages, if any, as well as the on-site scenario of all the parties' vehicles;
• not admitting liability or guilt;
• not abandoning the Vehicle without adequate provisions for safeguarding and securing the same, notify the police immediately if injuries are involved; notify the Company immediately upon occurrence of the accident, cooperate fully with the Company;
• Investigation of the accident or incident;
• Deliver to the Company at such applicable address every process, pleading or paper relating to any claims, suits or proceedings arising from such accident. In the event a claim, suit or legal proceeding, The Hirer shall cooperate fully with my Company and its representatives.  

The Company shall not under any circumstances be liable to make payment to The Hirer to indemnify the Hirer against any loss, injury or damage sustained by the Hirer or by any third party as a result of use of the said Vehicle.

MCL Garage provides 'Third Party Coverage' by their respective insurance. Third Party Excess charges are S$5,000.00 for any accidents arising due the negligence or other reasons Caused by the Hirer. For exact details of cover, please refer to the policy lodged with MCL Garage.

The said Vehicle shall be covered under a Commercial Motor Vehicle Insurance Policy which contains an excess clause of $5000.00. For Own Damage - Up to S$500,000 on type of Hirer vehicle. Section I, II, 19 years old and above, and more than 1 years of driving experience only.

All vehicles are strictly for Singapore use only, unless stated. If MCL Garage is not notified before the hired Vehicle enters Malaysia, the Hirer will be fully responsible for all first and third party liability damages, fire or theft and all other liquidating damages arising in Malaysia.

Prior to the end of rental expiration period or upon demand by The Company. The Hirer shall return the vehicle to MCL Garage in the same condition as received by the Hirer. Failing which, The Company shall be entitled to repair the Vehicle and the test thereof shall be recoverable from the Hirer.

The Hirer will be responsible for all ERP charges, all parking, traffic fees and fines incurred. The Hirer is responsible for all parking and traffic violations that may be incurred and shall answer all Police and Traffic Court Summonses, Notices and inquiries in connection herwith.

• The Hirer shall pay for the cost of petrol during the period of hiring. And keep the receipt of the pump. The Hirer shall return said vehicle with the same level of fuel. failing which would entail a petrol charge to the Hirer.
• The Hirer shall be deemed to have extended the period of hire by reason of the Hirer's failure to return the said vehicle. The Hirer shall also be bound by these terms and conditions in respect of any replacement vehicle provided.
• The Company shall not be liable for any repair or miscellaneous charges incurred at any external workshop without prior authorization.
• The Company shall not be liable to the Hirer or any persons for any alleged lost article, loss or damage, whatsoever and however caused by reason of me, Company resuming possession of the vehicle.
• In the breach of the terms and conditions of the Agreement, The Company reserves the right to resume possession of the hired vehicle at any time in the Company's interest without prejudice.
• The Hirer shall indemnify the Lessor on all debt collection and legal expenses incurred by the Lessor in the enforcement of its rights under this agreement.
• No smoking, durian and transportation of pets are allowed. If this condition is not complied with, the Lessor may charge the Hirer a cleaning and deodorization charge of S$300.
