RENTAL AGREEMENT

Key Terms & Conditions:

1. Singapore NRIC or Passport & Valid Singapore Driving License must be presented.
2. Only Registered Hirer is authorized to ride the vehicle.
3. Hirer is responsible for any damages, loss, or fines incurred during the rental of vehicle.
4. 5. It is the Hirer's Responsibility to make payment in advance if any extension of rental is required. Strictly no refund for any early return of the vehicle once payment is made.
6. Servicing and maintenance of vehicle to be done every 2 weeks / 1000km at authorized workshop.
7. All wear and tear cost will be covered by the company except: Tyre Punctures, Bike Damages, Chain loose, Stolen or Missing Parts, and Engine Overhaul due to hirer's wilful negligence.

TERMS AND CONDITIONS

Rwave Pte Ltd ("The Company")

Hirer / Authorized Rider ('Hirer')

Hirer must produce a valid Singapore NRIC and Class 2B Driving License.

Hirer guarantees that he / she is not under any suspension order on his/her Driving License.

Terms of Payment / Security Deposit

Hire charges and Security Deposit for the hire period is payable by The Hirer at the time of taking over the vehicle. The Hirer is to pay a mandatory deposit deemed fit by The Company for exceptional cases. It will be refunded back to The Hirer by cheque or cash, 14 days from the end of the hiring period. The Company will use the security deposit to offset any repairs, fines or summons incurred by The Hirer during the rental period. Al rental charges paid in advance is non-refundable.

Rates / Petrol / Rental Extension / Replacement Vehicle

All rates quoted are in Singapore Currency, SGD & include insurance, maintenance and unlimited mileage. Minimum rental charge is one-day's rate. Each excess day for late returning, The Hirer will be charged for the daily rate. The Hirer shall return the vehicle with the same amount of petrol given at the point of rental otherwise surcharge from $20-$50 is applicable upon return. The vehicle must be refuel using unleaded petrol at all time. At any point if The Hirer wish to extend the hire period, The Hirer is to inform The Company immediately and to make advance payment for the extension period, provided the hire extension is acceptable by The Company. If for any reason, the vehicle ordered by the Hirer is not available, The Company reserves the right to replace the vehicle with an alternative vehicle or if The Company decline to provide an alternative vehicle, The Hirer shall be refunded with the hire charges and deposit (if any) without interest and shall have no further claims against The Company.

Maintenance / Replacement Vehicle / Towing

The Company shall cover all preventive and corrective maintenance of the rented vehicle to maintain the operational readiness of the vehicle. That includes the replacement of tyres (if required) and replacement of battery (if required). The Hirer must bring the vehicle to the authorized workshop listed below for monthly servicing if needed.

Should there be a need for The Hirer to leave the rented vehicle at the authorized workshop for repair more than 1 working day, The Company shall issue a replacement vehicle (subject to The Company vehicle availability) free of charge till the agreed rental bike's repair works is done. Should there be any unforeseen circumstances which The Hirer is unable to bring the rental bike back for return on the agreed RETURN DATE, a towing service can be arrange. The towing service is available at $50/-

Liabilities / Fines / Damage to Vehicle / Lost of Vehicle / 3" party Claim Excess

Hirer shall be solely responsible for and hold The Company fully indemnified against all claims, demands, liabilities, losses, damages, proceedings costs, expenses, fines, penalties and liabilities imposed on The Company or arising in respect of any non-compliance or contravention of any transport, traffic or other law or regulation, together with the cost and expense including but without limitation costs on a full indemnity basis relating thereto incurred by The Company. The Hirer shall bear the cost of the repair, loss of use or rectification of any damages caused to the vehicle while in the possession of The Hirer. If the agreed rental vehicle is damaged to the extent that it is deemed by The Company to be a total loss, The Hirer shall pay The Company the cost of obtaining a replacement for the vehicle and shall also compensate The Company the loss of use of the vehicle during the period of reinstatement or repairs.

The Hirer shall also compensate The Company all towing, storage and administrative charges. If the vehicle is stolen or otherwise lost whilst it is in the possession of the Hirer, the Hirer shall compensate The Company the cost of obtaining a replacement vehicle and for loss of use for the period required to obtain the replacement. If there is an accident that results or possibly results in any Third Party claim and the Company Third Party insurance is involved, the Hirer is responsible to pay for 3rd party section 2 excess of $1500, $3000 for drivers at least 21yrs old and with at least 1-year experience, $4500 for drivers below 21 years old and less than 1-year experience. Insurance company and claim procedure shall be carried out by The Company only and hiring Third Party insurance company is NOT allowed.

Restriction on use

The Hirer covenants to use the vehicle only for Lawful and Legitimate purposes and not to use the vehicle for any unlawful purpose activity. Vehicle is restricted to Singapore use only. Hirer shall not take the said vehicle outside mainland of Singapore without the written consent of the Company. Failure to comply with this term may entail serious consequences and The Hirer shall assumed personal and full responsibility. In event of the said vehicle being damaged, confiscated, forfeited or seized as a result thereof, The Hirer shall indemnify The Company for all the losses incurred including the full value of the said vehicle. The vehicle is NOT covered by a motor insurance policy covering personal accident insurance for The Hirer and The Company shall not be responsible for any liability, claims and injuries or otherwise in connection with any accident death or other losses arising from the use of the Vehicle. The Hirer agrees that The Company shall not be responsible for any liability, claim, loss damage or press of any kind or nature caused directly or indirectly by the vehicle or its use. Full amount of Security Deposit will be forfeited if The Hirer exit Singapore with the vehicle without written consent by The Company. The Company reserve the rights to recover the vehicle from The Hirer and all costs of recovering the vehicle will be payable by The Hirer.

Cancellation and Other Conditions

The Company, at his discretion, may decide whether to reduce or waive off part of the monthly comprehensive maintenance component from the monthly rental amount. The monthly comprehensive maintenance component rate is to be determined by The Company. The Company reserve the rights to terminate the rental without any liability should The Hirer failed to make the monthly rental prepayment in advance. The Company can forfeit the security deposit placed for each motorcycle/scooter. Upon termination of the Rental Agreement, The Hirer shall return the vehicle to any of The Company workshops. The returned vehicle should be repaired to its original condition before returning to The Company. The Company reserve the rights to repair the motorcycle to its original condition and offset the repair fees from the security deposit before refunding (if any), the balance amount to The Hirer. The Hirer is NOT ALLOWED to sublet or lend the hired vehicle to a third party, during or within the rental period. If the vehicle is found to be ridden by anyone other than The Hirer named in t h e Rental Agreement, the vehicle will be seized by The Company without any refund. If The Hirer lend the vehicle to a third party without notification to The Company, and the vehicle is involved in an accident, The Hirer will bear the whole cost of the claim and repair costs of the vehicle rented and other third party claims. If the vehicle is involved in an accident, The Hirer has to inform The Company, the Police or other relevant authorities in writing of the accident and shall also notify The Company in respect of any claim arising thereafter from the accident. No admission compromise offer payment or indemnity shall be made by The Hirer without The Company's consent in writing. The Hirer shall render such information and assistance in connection with the accident as The Company or its insurers may require. No repair is to be done without The Company approval. If The Hirer is caught repairing the vehicle at any workshop unauthorized by The Company, compensation of S$1,500.00 is payable to the company. The Hirer is REQUIRED to return the vehicle key and key tag in the same condition when he / she rented from The Company. There shall be no refund for any early return of vehicle. Lost or accordingly to the repair costs to rectify the vehicle to the same condition as it was at the start of the rental, if the vehicle was used for racing, exiting Singapore without written consent, sublet / or lend without authorization by The Company, each cause will be payable as a “compensation” of S$1,500.00 to The Company by the Hirer. All charges and amounts shall be governed by and constructed in accordance with the laws of the Republic of Singapore and the parties agree to submit to the jurisdiction of the Courts of the Republic of Singapore. I/We have read and agree to the above-mentioned terms and conditions.
